The Experience You Need In These Difficult Cases

In New York, sexual abuse is said to occur when one of the parties does not or cannot consent to the act. You can face a range of charges if you are accused of sexual abuse such as:

  • Sexual assault, which can include forcible touching, persistent sexual abuse and aggravated sexual assault
  • Rape, which can include statutory rape, marital rape, date rape and gang rape

You will need an experienced attorney to fight these types of charges. There are three degrees of rape charges, and all of them are felonies. We are skilled at building a defense based on the evidence, which may include forensic or DNA evidence. If there were witnesses, we will thoroughly interview them.

Sometimes there is little or no evidence of the alleged rape or sexual assault. Then the case comes down to whether the other party consented to the act. This can be a complex matter to resolve, but you can rely on our experience in this area. In New York, a person did not consent to sexual intercourse if they lacked the capacity to do so. Generally, this can mean that the person was not old enough to consent (under age 17), that they had a mental or physical inability to consent or that they were unconscious or too intoxicated to consent.
